How can Fyshe Inc. help you with your Antenuptial Agreements?
- We will provide you with a consultation to enable you to decide on how you wish to be married, drafting of the agreement, notarial execution, lodgement in the Deeds office, registration and delivery after registration.
- We will on signature of the agreement, provide you with a letter confirming that you have entered into such a contract, which is sufficient for your marriage officer, priest or minister.
- On consulting with us, you and your intended spouse will have to provide us with details of your net assets. Simply put, this is the amount of your assets (any items of value owned by you), less your liabilities (any amount due for a mortgage bond, motor vehicle credit, credit card or loan due by you). You will also be required to furnish copies of your identity documents and if previously married – a proof of divorce.

- If you do not enter into a contract before marriage, you are married in community of property. This means that all the assets and liabilities fall into one joint estate and each party is liable for the others’ debt.
- If you enter into a contract excluding the Accrual system then each estate is separate during and after termination of the marriage (by death or divorce). In this case, any assets obtained during the marriage belong to the party who earned them.
- If you enter into a contract with the Accrual system, whatever the parties gain during the marriage stays with that party, but the party which has a smaller accrual at the end of the marriage will have a claim against the party showing a higher accrual. In essence, after termination after the marriage, the accrual of both parties is shared jointly.
